Winery owner gets prison for tax evasion

San Jose, Calif.—Brenda Jo Kibbee received a nine-month prison sentence and was ordered to pay $877,127 in restitution to the TTB for failing to pay excise taxes on wine sold through her Monterey Wine Services facility in Salinas, Calif. According to a statement released by the TTB, Kibbee failed to pay taxes on wine taken out of her cellar between August 2008 and May 2009 yet still charged clients for the tax costs.

Kibbee, 41, was indicted on Sept. 26, 2012 on 11 counts of failing to pay an excise taxes on wine. She pleaded guilty to one count in December of last year. At the sentencing held Sept. 16, U.S. District Court Judge D. Lowell Jensen gave Kibbee three years of supervised release in addition to the prison sentence. The TTB brought the charges against Kibbee after an investigation by the Internal Revenue Service.
